The Amanda Bynes drug case is falling apart … FAST … because the cops have absolutely NO HARD EVIDENCE that Amanda was ever in possession of weed, this based on information TMZ has obtained from law enforcement.

An NYPD official told TMZ … the police report mentions NOTHING of any marijuana recovered at the scene. According to the report, cops saw Amanda throw what they believe is “drug paraphernalia” out the window. The report also says cops smelled “a strong odor of marijuana.”

Based on multiple calls to law enforcement and others … it appears NO DRUGS were recovered … and that’s what Amanda has been saying all along.

As for the alleged bong … it’s almost certain it will never be admitted into evidence. TMZ broke the story … our producer spotted glass remnants on a sub-roof Tuesday and then called police and asked if they had inspected it. He was told they hadn’t, and was asked for the location where the glass was found. Cops arrived a short time later and presumably checked the sub-roof.

Here’s the problem … No one knows if anyone tampered with the glass remnants which sat for days, in the rain. The chain of custody has been irretrievably broken and it’s virtually certain the glass would not be admissible into evidence.

Short story … even if prosecutors try to nail Amanda for reckless endangerment by throwing something out the window — cops say she confessed to throwing a vase but she denies it — there’s no physical evidence of what was allegedly thrown. We’ve spoken with several lawyers who say it will be extremely difficult to convict her on reckless endangerment without physical evidence.

Short story — if you’re betting on this one, Amanda seems to be a pretty safe gamble.

Amanda Bynes was not inappropriately grabbed, fondled or groped during her arrest last week, the NYPD Monday said Monday, citing an onlooker who told authorities Amanda’s claims were merely a figment of her imagination.

“Internal Affairs investigators have found no evidence to corroborate Ms. Bynes’ allegations,” NYPD spokesman Paul Browne told the NY Daily News. “To the contrary, a credible civilian witness who was with the officers throughout told investigators that none touched Ms. Bynes inappropriately or otherwise engaged in misconduct at any time.”

The investigation came after the mercurial Bynes, 27, said on Twitter that the pair of responding officers “sexually assaulted” her, and that one even “slapped” her lady parts.

As we previously reported, Bynes has had a whirlwind few days, including an arrest in connection with suspicion of criminal possession of marijuana, reckless endangerment and felony tampering with physical evidence; a bizarre court appearance in which she claimed she threw a vase; explosive accusations against the officers who arrested her; and a vow to bring legal action against Gotham’s finest.

“For once and for all, this is the last thing I’ll say about the mistaken arrest,” Bynes tweeted. “I’m suing NYPD for illegally entering my apartment, lying about drugs on me and lying about me tampering with non existent drug paraphernalia, then I’m suing for being put into a mental hospital against my will.”

Amanda Bynes parents want their troubled daughter to seek in-patient treatment at a psychiatric hospital to deal with her unravelling mental health issues, which include hearing voices, RadarOnline.com has exclusively learned.

The ex-Nickelodeon star’s panicked folks, Rick and Lynn, don’t believe her “problem is rooted in an addiction to drugs,” a family insider revealed in the wake of a drama-packed 24 hours, which saw Bynes arrested and held for a psychiatric evaluation in New York.

“Amanda has been clearly using drugs, yes, including marijuana, but that is just the symptom. The fact is Amanda suffers from severe mental health issues that she refuses to accept. Rick and Lynn want her to seek in-patient treatment at a psychiatric hospital so she can be properly treated.”

The 27-year-old first began exhibiting alarming behavior in her late teens, the insider added, when she was starring in The Amanda Show and What I Like About You.

Revealed a source: “She even thought there were tracking devices in smoke detectors in her family home and would place sheets over them. Amanda also hears voices. It’s so sad for her family to watch her unravel like this.”

Bynes appeared in Manhattan Criminal Court Friday following her arrest Thursday evening for throwing a bong out the window of her apartment. She was charged with reckless endangerment, attempted tampering with evidence and unlawful possession of marijuana, all misdemeanors.

Bynes was subsequently released on $1,000 bail following the hearing.

As we previously reported, Rick and Lynn Bynes had been desperate to get a conservatorship for their daughter, but were told they’d be unsuccessful because the former child actress didn’t meet the strict criteria.

“They were advised that even as disturbing as Amanda’s behavior is, it’s very unlikely that a judge would sign off on a temporary conservatorship,” said a source.

“Conservatorships are very hard to get and being mentally ill and addicted to drugs isn’t enough. Amanda hasn’t ever been to rehab or ever agreed to see a mental health professional. Her parents are absolutely powerless to do anything at this point.”

When Bynes’ parents confronted her several months ago with their concerns,” she bolted from Los Angeles and moved to New York,” leaving their relationship extremely strained.

Meanwhile, the scandal-plagued star just “doesn’t think she has anything wrong with her. She refuses to see a psychiatrist and says everyone is just out to get her!”

Trouble-plagued actress Amanda Bynes was arrested by police in her New York apartment Thursday night and taken into custody for a psychiatric evaluation, the New York Police Department has confirmed to RadarOnline.com.

The 27-year-old ex-Nickelodeon star reportedly threw a bong out the window of her apartment when police arrived at the scene. They were responding to a report of a disorderly person.

She wasn booked for criminal possession of marijuana, as well as reckless endangerment and felony tampering with physical evidence, police said.

She was taken to Roosevelt Hospital to undergo a psychiatric evaluation, before being moved to a Midtown police station.

Bynes’ behavior has grown increasingly erratic. She has relentlessly pursued singer Drake on Twitter, feuded with Jenny McCarthy and most recently flown into a rage over photographs taken inside her apartment — photo she says are fake.

As Radar was first to report, Bynes escalating disturbing behavior has been fueled by drugs, with the former star smoking a large amount of pot. “it make her more paranoid instead of mellowing her out,” one source told Radar.

Her parents have been concerned about her for quite some time but have no control over the situation and Bynes has pointed out that she does not talk to them.

Amanda Bynes has remained relatively under the radar lately — for her — which has her friends and family feeling optimistic about the 27-year-old’s future with one source exclusively telling RadarOnline.com, “She’s doing much better.”

The former Nickelodeon actress hasn’t been tweeting as much as she once used to and those close to Amanda say it’s because she’s been in a better headspace.
